Giving and Getting Consent
The issue of consent is critical to sexual responsibility. The absence of "no" isn't the same thing as "yes". Being sexually responsible means making certain that you obtain consent for any sexual activity, every time.
- Under Florida law, having sex with someone who is drunk or incapacitated for any reason is considered felony sexual battery (rape) because they are unable to give consent.
- If you are not sure that the other person has consented or is able to consent, keep yourself and the other person safe by refraining from sexual activity.
- Watch out for the safety of your friends and acquaintances at parties and other events to make sure that no one is taking advantage of their vulnerability.
- If you or someone you know has been raped, know that there is help at USF. An advocate from USF's Center for Victim Advocacy and Violence Prevention is available to consult with you confidentially.
